Terms and Conditions
The following are the terms and conditions you are
asked to accept when you register to use the web site of
the NEAC Trading Company. Please use this page to preview
the terms and conditions before registration, or as a handy
reference after registration.
This agreement is a legal document which sets out your
rights and obligations, and those of The NEAC Trading Company,
which is a company registered in England under registration
number 5076644, in relation to the services offered by The
NEAC Trading Company through www.newenglishartclub.co.uk.
This website is operated by The New English Art Club - a
Charity registered in the United Kingdom - Charity Number
295780. The registered office of The NEAC Trading Company
is 18 Poplar Road, New Denham, Uxbridge, Middlesex UB9 4AW
Effect of this agreement
Viewing of the newenglishartclub website itself is free;
but, when you register for the site, you agree to the terms
of this agreement. You also reaffirm that agreement every
time you use The NEAC Trading Company's services. We recommend
therefore that you read this agreement.
Applicable Law
The NEAC Trading Company is a company registered in England,
and every sale shall be deemed to be performed in England;
English law shall govern each transaction, including (without
limitation) all contractual and other relationships, which
arise as a result of such sales. You and we submit to the
exclusive jurisdiction of the English courts in relation
to any disputes arising out of any sale.
Making a contract with us
In return for the service we will provide, we ask that you
agree to register for The NEAC Trading Company's sales using
your correct name, address and any other requested details.
You may be asked to enter credit, debit or charge card details.
You must ensure that (a) you are fully entitled to use that
card at the time when you provide those details to The NEAC
Trading Company, and when you use the card, and (b) the
card has available funds to cover all charges incurred on
it in the course of buying from us. If any of the information
you enter becomes incorrect or is superseded, please notify
us with the correct information immediately.
In any event, to register for The NEAC Trading Company's
services, you must be able legally to enter into contracts
for goods and services that you may buy here.
Ordering and Shipping
The NEAC Trading Company accepts Visa, Mastercard, JCB,
Switch, Solo and Electron; you may also pay by
sending a
cheque
or Postal Order payable to The NEAC Trading Company Ltd
to the Sales Administrator, 21 Guest
Avenue, Emersons Green,
Bristol BS16 7GA, UK. A secure online credit card order
can be made by following the four easy steps from the
'Buy
Now' links.
Your card will not be charged until the item(s) is
ready to despatch. On the completion of an order from within the United Kingdom
(not
Channel Islands
or Isle of
Man),
the item(s) will be dispatched by us and at our expense. If
you are ordering from outside the UK (or from the Channel
Islands or Isle of Man), you will have to meet the additional cost of shipping.
You should therefore,
before completing the purchase, email the Sales Administrator
of The NEAC
Trading Company to find out the shipping costs of the item.
If you accept this cost, it will be added to the purchase
price. To monitor the status of your order online, log
on to the system from the 'My Account' link, or email the Sales Administrator.
Returns and Refunds
If you are not happy with the purchase you have made, for
whatever reason, you may return the purchase to the
originator
in its original condition for a full refund provided that
you inform the Sales Administrator of The NEAC Trading
Company
within 30 days of you accepting delivery of the work. You
will normally be required to pay the costs of the return,
which can be arranged by email with the Sales Administrator
of The NEAC Trading Company. The costs of return will
be
deducted from the sum to be refunded to you unless you
have returned the item under your own arrangements.
If any artworks
have been damaged in transit to you, you must inform immediately
the Sales Administrator, who will arrange for the NEAC
Trading
Company's freight contractor to collect the artwork. Provided
that the damage occurred during transit, you will receive
a full refund from The NEAC Trading Company.
Complaints Policy
If you are not satisfied with the quality of The NEAC Trading
Company's service please contact the Sales Administrator
who will respond within 5 working days. Please remember
that all complaints are treated as confidential.
Misuse of our Site
The NEAC Trading Company reserves the right to suspend or
terminate anyone's account which, is, or appears to us in
our absolute discretion, to be in breach of any of the provisions
of this agreement.
When will your credit card be charged?
As soon as your order is processed for orders from within
the UK (mainland). For orders from outside the UK (or
UK highland and islands), the order will be
processed once the purchaser has agreed to pay the delivery
costs.
Tax and Duties
The NEAC Trading
Company is not, at present, registered for VAT.
If you want your purchase to be delivered outside the European
Union, you will be responsible for the
payment
of all applicable duties.
Corrections
The descriptions of goods and services included in The NEAC
Trading Company's site are accurate to the best of our knowledge.
We do our best to correct errors or omissions as soon as
we are aware of them. However, you should be aware that
the colours and appearance of images may vary very slightly
from the way they appear on the screen.
Copyright
The images and designs used on The NEAC Trading Company's
website are the property of The NEAC Trading Company or
their respective copyright owners, and are used by The NEAC
Trading Company pursuant to express authorisation from copyright
owners or their agents. You acknowledge that all copyright,
trademarks and other intellectual property rights in and
relating to The NEAC Trading Company are vested in The NEAC
Trading Company or our partners where appropriate. You must
not use, reproduce, modify or distribute our images or any
part of those images in any manner, whatsoever. In the event
that there is any dispute between us in relation to this
issue, you agree that until the matter is resolved, an interim
injunction will be an appropriate remedy. An interim injunction
is a court order which would prevent any further use or
distribution of the image concerned, until a final court
hearing where the court will make a decision based on all
the facts.
Loss
Please be aware that we will not be liable to you or any
third party for any indirect loss or damage, or for any
loss of data, profit, revenue, business or management time,
howsoever caused.
This does not affect your statutory rights as a consumer.
Reasonable Control
The NEAC Trading Company shall not be liable for any failure
to perform its obligations under this agreement if caused
by matters beyond its reasonable control. Matters deemed
beyond The NEAC Trading Company's control include
- Riots and other forms of civil commotion
- Floods, fires and other natural disasters
- Local legislation and regulations
- Acts of God
- Matters of regional or national crisis - e.g. blockade,
war etc.
Changes to this Agreement
The NEAC Trading Company reserves the right to change the
terms of this agreement when it is deemed necessary, and
to post a new version on our website. The new version will
take effect from the day of posting on the site. Contracts
made prior to this day remain under the terms applicable
at the date of the contract. Price and availability information
are also subject to change without notice.
Severability
In the event that any term of this agreement is held to
be unenforceable or invalid by judicial decree or decision,
the remainder of this agreement shall remain valid and enforceable.
Passwords
To use certain features of the Service, you will need a
username and password, which you will receive through the
Service's registration process. You are responsible for
maintaining the confidentiality of the password and account,
and are responsible for all activities that occur under
your password or account. You agree to inform The NEAC Trading
Company immediately of any unauthorised use of your password
or account or any other breach of security, and to ensure
that you exit from your account at the end of each session.
The NEAC Trading Company cannot and will not be liable for
any loss or damage arising from your failure to protect
your password or account information.
You may not disclose or share your password to any third
parties or use your password for any unauthorised purpose.
Security and Privacy
We want to reassure you that any information you give us
as well as any that we know about you by other means will
be well protected. We also feel it is important that you
know exactly how any information you provide us with is
used.
What information do we collect?
The NEAC Trading Company requires some basic information
for its services. The registration page contains all the
information that we need in order to process your purchases.
When making an order we will also require payment details.
All information is collected in accordance of the UK Data
Protection Act 1998.
How we use your data
Use of personal information collected by The NEAC Trading
Company is strictly confidential and protected under the
Data Protection Act. The privacy policy forms part of the
agreement between us, and by purchasing goods from our site,
you agree to be bound by the terms and conditions of the
agreement between us. You also give your consent to the
way we may handle your personal data in the way stated in
this policy statement. Newenglishartclub.co.uk and The NEAC
Trading Company will not use this data, or disclose it to
any other party, either during registration or at any other
time, without your express permission, given during registration
or at some other time. We may, however, disclose this data
if compelled to do so by law.
The web site uses session variables to help enhance the
user experience, and for some of its essential functions.
For session variables to work, cookies must be enabled
on the user's browser. If you choose to disable cookies,
the web site will not function correctly, and you will
not be able to make any purchases. Session variables are
destroyed when the current browser session is closed.
To help us improve our service to you, we collect and
examine statistical data relating to the popularity and
usage of
particular
aspects of the newenglishartclub.co.uk site. This is done
by the site software and also by the web server which
logs usage. This statistical information cannot be related
back to an individual.
Please note that newenglishartclub.co.uk has a strict
no 'spam' policy. That is we will not contact you with
unsolicited
commercial information unless you specifically request
it. You may subscribe to any of the information email lists
that newenglishartclub.co.uk provides, and at any time,
you can remove yourself from these lists through the accounts

How we protect your data
Any credit card information you give us is handled on
our behalf by Barclays Bank plc, using their secure ePDQ
servers. At no time do we have visibility of your credit
card details
for purchases made through the site. In the highly unlikely
event that our site security
is breached for any reason, your credit card details
would not be found.

Sales by Third Party Organisations
The sale of some items displayed on the newenglishartclub.co.uk
site, such as videos and books will be processed completely
by separate organisations such as amazon.com and apvfilms.com
. Such sales will be conducted solely under the terms
and
conditions specified by each site.
Website Names
You should note that www.newenglishartclub.co.uk has an
alternative address of www.neac.co.uk and that these terms
and conditions also apply for the alternative address.
